How Quickly Can A Divorce In Texas Be Over?

Spouses seeking a divorce usually want their divorce lawyers to make it happen as quickly as possible.

What every divorcing spouse must understand is that the Texas family code mandates a minimum waiting period before divorce and/or custody agreements can be finalized and signed.

With this in mind, spouses should work closely with their divorce attorneys to spend that time resolving any issues between spouses and developing an acceptable divorce agreement to present to the court for finalization.

Texas Has A Mandatory 60-Day Waiting Period

The state of Texas mandates a 60-day divorce waiting period that begins on the day that a spouse and their divorce lawyer file the paperwork with the court.

During that period which is required to give receiving spouses the opportunity to respond and couples time to work out their affairs, spouses should work with their lawyers on negotiating the terms of the divorce and child custody.

A divorce agreement that both spouses agree to should be drafted and prepared to be presented to the court on Day 61.

With the assistance of experienced divorce attorneys, a couple can be legally divorced on that 61st day as long as their agreement is approved by the family court and signed by the judge.

Certain Situations Can Delay Divorce Finalization

An important detail that all spouses waiting for those mandatory 60 days to pass must also realize is that in some situations, divorces will take longer than 60 days.

Divorce lawyers find that for spouses with disputes during the negotiation process, whether relating to property distribution, child custody, conservatorship, or anything else, the process of developing an acceptable divorce agreement can take much longer.

These cases can go on for months or as long as a year.

An inability to resolve issues that lead divorce attorneys and their clients to court will delay the process even more.
